Terms of Service

Welcome to CardVerse, a Canadian marketplace where players and collectors buy and sell Magic: The Gathering cards. By using CardVerse, you agree to these Terms of Service. Please read them carefully before creating an account or making a sale/purchase.

1. Who We Are

CardVerse provides the platform that connects independent sellers (“Shopkeepers”) with buyers. We do not directly handle the items being sold, inspect them, or guarantee them.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form legally binding contracts. You warrant that the information you provide (name, address, email, payment details) is accurate and current.

3. Role of CardVerse

  • We provide technology, payment processing (via partners like Stripe), and listing infrastructure for a marketplace.
  • We are not a party to the sale of goods. The contract for purchase is between the buyer and the Shopkeeper.
  • We do not adjudicate disputes between buyers and Shopkeepers, though we provide a channel for complaints (see Section 7).
  • We are not responsible for the description, condition, shipment, or delivery of goods. These are the Shopkeeper’s responsibilities.

4. Shopkeeper Responsibilities

If you list items as a Shopkeeper, you must:

  • Provide an accurate description of each card (set, edition, language, foil status, condition).
  • Set fair pricing and honour it once a buyer purchases the item.
  • Ship orders within 7 days of purchase, using a reliable method, and update tracking if applicable.
  • Respond to buyer communications in a timely and respectful manner.
  • Comply with all applicable laws (taxes, export/import, trade in collectibles, and similar).
  • Bear full liability for your listings and sales.

Failure to meet these responsibilities may result in complaints, suspension, or permanent removal of your account.

5. Prohibited Items & Conduct

Prohibited listings:

  • Counterfeit cards, fake cards, proxies, or any items that misrepresent authenticity. Listing or selling these will result in immediate, permanent ban.
  • Hacked or altered digital cards (if applicable).
  • Items that are illegal to sell in your jurisdiction.

Prohibited conduct:

  • Harassment, hate speech, threats, abusive or discriminatory language in any buyer-Shopkeeper communications.
  • Attempting to bypass CardVerse policies or fees.
  • Impersonating another user or falsifying listing data.

6. Pricing & Market Fluctuations

  • Once a buyer purchases a card, the sale price is binding. The Shopkeeper is expected to honour the sale.
  • If the market price of a card rises after a sale, that does not relieve the Shopkeeper of the obligation to ship the card at the agreed price. CardVerse cannot intervene when a Shopkeeper refuses to honour a sale because “the card is worth more now.”
  • Repeated refusal by a Shopkeeper to honour confirmed sales may lead to account suspension or ban.

7. Complaints & Reviews

  • Buyers may raise a complaint to CardVerse via the designated complaints channel (see Section 12). We will log the complaint and may review the Shopkeeper’s account.
  • CardVerse does not mediate each individual sale. We rely on the community and Shopkeepers to resolve issues directly.
  • Multiple validated complaints against the same user (Shopkeeper or buyer) may result in suspension or removal of their access to the Platform.

8. Liability & Disclaimers

  • The Platform is provided on an “as-is” and “as-available” basis.
  • CardVerse does not guarantee the authenticity, quality, legality, or suitability of any item listed.
  • CardVerse is not liable for any loss—direct, indirect, special, incidental, or consequential—or damage (including lost profits or data) resulting from your use of or inability to use the Platform.
  • All liability for listings, shipments, sale obligations, taxes, customs, and similar rests with the Shopkeeper.
  • Where exclusions are not permitted by law, liability is limited to the maximum extent allowed.

9. Suspension, Termination & Account Removal

CardVerse may suspend or terminate your account and refuse any future use of the Platform if you:

  • Receive multiple valid complaints,
  • List or sell counterfeit items,
  • Harass or abuse other users,
  • Attempt fraudulent transactions, or
  • Otherwise violate these Terms.

On termination, you must stop using the Platform, and any pending sales listings may be cancelled.

10. Modifications to These Terms

We may update these Terms from time to time. We will publish the revised version on the Platform with an updated “Last updated” date. Your continued use of the Platform after such changes means you agree to the new Terms.

11. Governing Law & Dispute Jurisdiction

These Terms are governed by the laws of Alberta, Canada. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada. If any part of these Terms is found invalid or unenforceable, the remainder will remain in full force and effect.
